Rajasthan Real Estate Appellate Tribunal(REAT)

The Real Estate (Regulation and Development) Act, 2016 was brought into effect by Govt. of India on 01.05.2016. The Rajasthan Real Estate (Regulation and Development) Rules, 2017 were notified on 01.05.2017. Govt. of Rajasthan has constituted the Rajasthan Real Estate Appellate Tribunal (Raj. REAT) on 01.05.2017. Govt. of Rajasthan has appointed Hon'ble Mr. Justice Veerendr Singh Siradhana as Chairman, Rajasthan Real Estate Appellate Tribunal (Raj. REAT) on 26.02.2021. Govt. of Rajasthan has appointed Sh. Brijesh Kumar Dangra as Member Judicial and Sh. Rajendra Kumar Vijayvargia as Member Technical of Rajasthan Real Estate Appellate Tribunal (Raj. REAT) on 06.03.2019. The Tribunal's office started functioning with effect from 1st march 2021, at Anand Bhawan Sansar Chandra Road, Jaipur

1. The Form and manner of filling appeals

Every appeal under Section 44(1) of the RERA Act, 2016 is to be preferred within a period of 60 days. The days be counted from the day of uploading of the order on Authority's website/copy of the direction or order or decision made by the Authority or the Adjudicating Officer is received by the appropriate Government or the Competent authority or the aggrieved person. The online appeal shall be filed in web based form 'M' [Vide rule 27(2) of the Rajasthan Real Estate (Regulation and Development) Rules, 2016, as provided on E-filing portal of the REAT Rajasthan along with following documents, namely

  • Authenticated copy of the order against which the appeal is filed
  • Copies of the documents relied upon by the appellant and referred to in the appeal; and
  • An index of the documents.
  • Apart from e-filing of the appeal in form 'M' and annexures, the Memorandum of appeal along with annexures shall also be furnished in triplicate hard copy at the filing counter of the Tribunal's office.
  • Flagging of every annexure and other important documents such as application (s), vakaltnama, calculation sheet, order challenged etc. should be done.
  • Appeal filed should accompany brief synopsis of the case.
  • When an appeal is presented after expiry of the period of limitation as specified in the Act, Such memorandum of appeal shall be accompanied by an application supported by an affidavit setting forth the facts on which the appellant relies to satisfy the Tribunal that they had sufficient cause for not preferring the appeal within the period of limitation
  • No new documents which have not been produced or relied on before the Authority or Adjudicating Officer of RERA, shall be produced at the time of filing of Appeal. However, parties can file additional documents along with an application under Order 41 Rule 27 of the Civil Procedure Code, 1908 and the same shall be considered by the Appellate Tribunal while hearing the Appeal, after giving an opportunity to the other side.

2. Filing Procedure

Every appeal shall be filed through online system by e-filing facilitated on the web portal of REAT Rajasthan by furnishing party details, address proof, ID proof, Email ID, Mobile number and other requisite information sought in the field provided therein.

The parties shall upload the contents of Memorandum of appeal and application/s if any, in PDF form. Similarly the documents relied and referred to in the Appeal shall be uploaded in PDF form.

Soft copy of complete appeal filed is required to be provided in PEN DRIVE. No soft copy will be accepted through E-mail.

Upon online registration as an Appellant, and post e-filing procedure stated above, if the appeal is presented through an Advocate, necessary 'vakalathnama' shall be filed at the filing counter of the Registry of the Appellate Tribunal. The said 'vakalathnama' shall contain address of the Advocate with enrolment number with the Bar Council, Email ID, Mobile number etc., for proper communication. 'Vakalatnama'/Power of Attorney should be complete in all respects (along with Board Resolution in case of promoter's appeal). The certified copies of impugned order(s) or direction or decision of the Regulatory Authority or Adjudicating Officer, as the case may be, shall also be filled at the filling counter.

In the event of filing any application, Review Petition, Caveat Petition or Execution Petition, the above E-filing procedure shall be followed

3. The Fee Payable

Every appeal filed under sub-section (1) of Section 44 shall be accompanied by a fee of Rs 5,000/- ( rupees five thousand) in the form of a demand draft or a banker's cheque drawn on a Nationalized bank in favour of the Rajasthan Real Estate Appellate Tribunal, Jaipur and payable at Jaipur or proof of payment through online digital mode.

The online digital payment of fee will be made for which bank details are as under :-

  1. Name of Beneficiary

  2. Name of The bank

  3. Account no.

  4. IFSC Code

  5. Branch Code

As per sec 43(5) of Real Estate (Regulation and Development) Act,2016, if promoter files an appeal with the Appellate Tribunal, it shall not be entertained, without the promoter first having deposited with the Appellate Tribunal at least 30% of the penalty, or such higher percentage as may be determined by the Appellate Tribunal, or the total amount to be paid to the allotte including interest and compensation imposed on him, if any, or both, as the case may be, before the said appeal is heard along with details calculation sheet.
